Who may do what in Massachusetts
Massachusetts has no med spa licence and no med spa law. The Department of Public Health (DPH) applies an existing rule instead. A med spa that gives medical services is a clinic needing a DPH clinic licence, unless the business is wholly owned and controlled by their practitioners and does not use "clinic", "institute" or "dispensary" in their name.12
The Board of Registration in Medicine says there may be no delegation of medical services to a person who is not licensed to perform them in Massachusetts.3 That is the opposite of Colorado and Idaho, which let a physician delegate some of these treatments to unlicensed staff.
These rules are current as of 29 October 2026. A 2026 bill on med spas, H.5455, now only orders a DPH progress report by the end of 2027, and sits in House Ways and Means.24

Our text does not address: laser technician. Physicians may do all of these treatments. Their advertising must carry their name, business address and degree.3 The 2024 memorandum says advertising that suggests a service is done by a licensed and qualified provider when it is not is misleading and a ground for discipline.5 Physician assistants (PAs) work under a physician's supervision, which is continuous but does not require the physician to be present.1011 Nurse practitioners may order tests and treatments and write prescriptions.8 One with at least two years of supervised practice may prescribe without supervision after an attestation to the Board. One with less must follow signed guidelines with a supervising physician or advanced practice nurse.9 The Board of Nursing's Advisory Ruling 13-01 says registered nurses (RNs) and licensed practical nurses (LPNs) may give aesthetic procedures such as neurotoxin and absorbable fillers "pursuant to the orders of a duly authorized prescriber". The patient assessment is by an RN or prescriber. A nurse who is not an advanced practice nurse may not select the medication, dose, device or setting. The setting must have policies for informed consent and a documented evaluation by an authorized prescriber.6 A separate ruling says prescribers may not delegate activities outside a nurse's scope, even if the prescriber is on site.7 Dentists may use botulinum toxin and dermal fillers as part of a patient's comprehensive dental treatment plan, after at least eight hours of training per product.12 We found no state medical assistant licence. Medical services may not be delegated to unlicensed people.3 Ask who will inject you, what their licence is, and which physician or prescriber ordered your treatment.

Our text does not address: physician assistant, laser technician. DPH requires a facility with one or more Class 3B or Class 4 lasers to register with its Radiation Control Program before operating and to name a Laser Safety Officer. The rule says no one may state or imply that DPH has approved the activity because it is registered.13 Laser registration now runs through an online portal that needs a login.28 We found no laser operator licence. Laser hair removal is a point where the state's sources disagree. The law on laser electrolysis, the Committee on Acupuncture's policy and the Cosmetology Board's policy reserve laser hair removal to licensed electrologists and physicians.141516 The Board of Nursing's ruling lists non-ablative laser hair removal among procedures RNs and LPNs may do on a prescriber's order, and says ablative lasers are for advanced practice nurses only.6 We found nothing that settles which reading governs. Cosmetologists, estheticians and electrologists may use intense pulsed light for hair removal after at least 30 hours of training on the device, but not any device or setting that allows laser electrolysis.17 DPH has said laser tattoo removal must be registered and that cosmetic laser use is the practice of medicine.29

The Cosmetology Board bars estheticians from injections, tattooing, lasers for hair removal, chemical peels or microdermabrasion that go beyond the epidermis, dermal microneedling, radiofrequency, body contouring and the title "medical aesthetician", which the Board says "does not exist under the law".16 They may do epidermis-only microdermabrasion or dermaplaning after documented training, and microneedling that stays in the epidermis.16 A licensee who does a delegated medical service does so outside the esthetician licence.16

Our text does not address: doctor, nurse practitioner, physician assistant, esthetician, laser technician. The Board of Nursing's ruling on infusion therapy says RNs and LPNs give it on a prescriber's order, with the assessment by an RN or prescriber. IV hydration in a wellness clinic or mobile unit must meet the same requirements.18 Non-nurses are barred from starting IVs by the rule against delegating to unlicensed people.3 We found no stand-alone Massachusetts rule on IV clinics. Ask who will examine you before the drip, who ordered it, and who will place the IV.

No Massachusetts statute or rule we read names semaglutide or tirzepatide. The Board of Pharmacy's practice standards and its rule on outsourcing facilities do not name them in the parts we searched.21 Ask whether your medicine is FDA-approved or compounded, and which pharmacy prepares it.

The DPH advisory ties the clinic-licence rule to ownership. A business that is wholly owned and controlled by their practitioners is exempt, and one that is not needs a licence.12 So a non-practitioner owner generally must hold a DPH clinic licence. Whether Massachusetts also bars lay ownership of a practice under the corporate practice of medicine is not settled by any official source we read. Separately, a centre that does procedures under general anesthesia or moderate or deep sedation, or any liposuction, needs a DPH licence as an office-based surgical center. We found no regulations implementing that law.19
| No licence-by-licence answer. | ||||||||
Practising medicine without registration is a crime.4 DPH's advisory lists as medical services laser, light and radiofrequency devices, chemical peels, soft tissue fillers, botulinum toxin and sclerotherapy, and any procedure that uses a material, chemical, mechanical device or energy.1 A business that gives these services as ambulatory care and is not wholly owned and controlled by their practitioners needs a clinic licence. DPH's 2024 memorandum says it may refer a business that holds itself out as a clinic, or gives medical services without a licence, to the Attorney General.15 Clinic licensure rules require a professional services director, and at least one physician present whenever medical services are given, unless they are given under written protocols by a physician assistant or an expanded-role nurse.20 No statute or rule requires a "medical director" for a med spa by that name. Anyone who buys, stores or dispenses prescription medicine needs a Massachusetts Controlled Substances Registration, clinic or not.5
| No licence-by-licence answer. | ||||||||
Massachusetts has no state licence for tattooing or permanent makeup. DPH told local boards of health in 2001 that there is no direct statutory authority for statewide body art regulations, and local boards make their own under a general health law.2223 The Cosmetology Board allows permanent makeup in a salon only in a dedicated room, with the required local licences.16

Massachusetts questions
Who may treat you
Who can inject Botox or fillers in Massachusetts?
A physician, or a licensed physician assistant, nurse practitioner, RN or LPN working within their scope and, for RNs and LPNs, on a prescriber's order. Massachusetts does not allow delegating medical services to someone who is not licensed. Ask who will inject you and what their licence is.
Does Massachusetts license medical spas?
There is no med spa licence. DPH treats a med spa that gives medical services as a clinic needing a DPH clinic licence unless it is wholly owned and controlled by their practitioners and avoids the words clinic, institute and dispensary in their name.
Does a Massachusetts med spa need a medical director?
No statute or rule requires a medical director for a med spa by that name. DPH-licensed clinics must name a professional services director. Ask which physician or prescriber is responsible for the person treating you.
Can unlicensed staff do injections or lasers in Massachusetts?
The Board of Registration in Medicine says there may be no delegation of medical services to a person who is not licensed to perform those services in Massachusetts.
Who can use a laser on me in Massachusetts?
A physician, or a nurse under a prescriber's order. State sources disagree on laser hair removal, which several say is for electrologists and physicians only. Class 3B and 4 laser facilities must register with DPH.
Can an esthetician do microneedling or chemical peels in Massachusetts?
Only treatments that stay in the epidermis, according to the Cosmetology Board's policy. It bars dermal microneedling, deeper peels and injections. The Board also says the title medical aesthetician does not exist under the law.
What does Massachusetts say about compounded weight-loss drugs?
No Massachusetts statute or rule we read names semaglutide or tirzepatide. Anyone who buys, stores or dispenses prescription medicine needs a Massachusetts Controlled Substances Registration.
How do I check a licence in Massachusetts?
Use the Bureau of Health Professions Licensure's verification site for nurses, PAs, pharmacists and dentists, and Find My Doctor for physicians.
